Overtime pay?
I'm working for this company that once you go over your 40 hours they won't pay overtime, wht they do is they put on the check "retro" hours, so nobody can qustion it, but is this legal or what, also what they do, since you get pay every 2 weeks if you worked 60 hours on the first one, they make you work 20 hours on the second one BUT they only pay 80 regular hours, i don't think this is right, who should i contact on this matter? and i really DON"T want to give my name AT ALL!!!
WHAT CAN I DO?
If you are an exempt empoyee on a salary this is legal. Salaried employees (only if properly classifiable as exempt) receive the same pay each week regardless of the number of hours worked.
However if you're non-exempt and are paid an hourly wage this is NOT legal. They MUST pay you for the actual hours worked EACH WEEK. In the example you have given you'd be paid 40 hours of straight time plus 20 hours of overtime on the first week and 20 hours of straight time on the second week.
If you are paid hourly and your employer is pulling this stunt, contact your State labor board and file a formal complaint. If this has been going on for a while, you may be shocked at the payment that you receive -- and the tax bill that will go along with it but that's another story entirely.
Brian was doing fine with his answer until he hit on comp time. Employers may NOT get out of paying overtime wages by offering comp time off!
